Alyssa Mercante Sues!

Former Kotaku Editor Alyssa Mercante Files
Lawsuit Against YouTuber Smash JT
December 13, 2024
Alyssa Mercante, who was once a Senior Editor at Kotaku, has initiated legal proceedings against the YouTube content creator known as SmashJT in the United States District Court for the Eastern District of New York. The 54-page lawsuit accuses SmashJT of defamation, stochastic terrorism, bias-related violence or intimidation, intentional infliction of emotional distress, and tortious interference. This legal conflict has captured significant public interest, sparking discussions on free speech boundaries, digital accountability, and cultural clashes within the gaming community.

The Allegations
Mercante's legal action claims that SmashJT disseminated defamatory content about her through multiple YouTube videos, notably accusing her of prostitution. She alleges these statements were made with "actual malice," leading to considerable damage to her professional reputation, loss of economic opportunities, and causing her profound emotional distress.

The lawsuit further charges SmashJT with a consistent pattern of behavior intended to harm Mercante, using terms like "stochastic terrorism" and "bias-related violence or intimidation" to describe how his content purportedly incited his viewers to target her with harassment.

Mercante's Online Presence
Mercante is recognized for her outspoken and sometimes provocative social media activities, especially on topics like diversity, inclusion, and gaming culture. Her posts, which include semi-nude images and discussions of personal intimate matters on X, have stirred debates about her professionalism and public image. Critics argue that such posts undermine her journalistic integrity.

SmashJT's Response
Smash JT has responded to the lawsuit by Alyssa Mercante by asserting that his content falls under fair use and protected speech. He denies any intent to incite harassment, instead framing his videos as critical commentary on perceived ideological shifts within gaming journalism. He has publicly stated through his website and social media that the lawsuit is an attempt to silence his independent voice and critiques of industry narratives. His legal team, led by Ron Coleman, has rejected the accusations made by Mercante, particularly those concerning defamation and harassment.
  • Fundraising Efforts: In response to the lawsuit, Smash JT launched a defense fund on GiveSendGo, initially aiming to raise $25,000 to cover legal expenses. This fundraiser was met with significant support from the gaming community. According to posts found on X and information from his website, the defense fund quickly surpassed its goal, raising over $40,000 within a short time frame. This response from the community was not only financial but also a show of solidarity against what many perceive as an attempt to misuse legal mechanisms to silence criticism.

Legal and Cultural Implications
This legal battle explores complex issues regarding defamation limits and the impact of online speech on public figures. It also prompts broader cultural inquiries into how creators, journalists, and platforms should contribute to constructive dialogue in gaming communities.

A recent Fox News article pointed out the growing ideological conflicts in gaming. Attorney Jeremy Hambly, familiar with similar disputes, described these events as part of a broader "purge" of dissenting voices, potentially alienating traditional gaming fans and suppressing creativity and open discussion.

May need to signal boost this situation to get @elonmusk attention. She’s coming at me with a frivolous lawsuit trying to set a dangerous precedent, push activism, and destroy truth in journalism for gaming.

Mercante’s lawsuit encapsulates these cultural tensions, with her legal team arguing that her experiences highlight the perils of unchecked online harassment and defamation.

Broader Context
The gaming sector has always been a cultural and ideological battleground. This lawsuit, involving a notable former journalist and a well-known content creator, epitomizes the escalating friction between traditional media and independent content producers.
Don McGowan's Views on Gamers and Industry Practices

Don McGowan, a lawyer featured in a recent Fox News article, has shared several notable perspectives on gamers, particularly regarding cultural and ideological shifts within the gaming industry:

  1. On Anti-Woke Gamers:
McGowan has been outspoken against what he refers to as "anti-woke gamers." In a now-deleted thread on X, he admitted that part of his job involved "getting rid" of these individuals, describing them as "aholes" and "human garbage." He argued that trust and safety teams exist to remove such individuals, emphasizing that "adult humans don’t want to spend their leisure time with aholes." He accused these gamers of harboring sexist and racist attitudes, claiming their resistance to diversity initiatives is harmful.

  2. Critique of Gamer Culture:
McGowan has criticized traditional gamer culture as "embarrassing," asserting it revolves around consumerism, memes, and online outrage rather than genuine culture. He advocates for a shift towards a more inclusive and diverse gaming community, moving away from what he considers outdated gamer identities.

  3. Cultural and Industry Shifts:
McGowan has defended the increasing influence of diversity-focused consultancy firms like Sweet Baby Inc. in the gaming industry. Reflecting on his experiences at companies like The Pokémon Company and Bungie, he highlighted his role in managing the ideological landscape of gaming communities, often clashing with traditional audiences resistant to change.
